As previously reported, the FCC issued a Public Notice soliciting public comment regarding the draft Eligible Services List for FY2010 on June 2, 2009. The initial comment period closed on June 23, 2009, and comments were submitted by technology vendors, equipment manufacturers, telecommunications companies, E-rate consultants, and other organizations.

Many of the comments expressed agreement with the proposed changes and modifications to the ESL, and several commenters admonished the FCC for releasing the draft ESL much earlier in the calendar year than in years prior. Other commenters noted concerns that several of the definitions in the ESL were not clear, and opinion was split between several commenters on the issues of password protected and intranet web hosting, telephone broadcast messaging, and e-mail archiving. In addition, several commenters proposed the addition of several new products and services as eligible for E-rate discounts.
