The Federal Communications Commission is seeking comments on a petition from the State of Tennessee, seeking immediate relief that would enable it to change a service provider for the 2002 funding year before its funding commitment decision letter is approved.
The state petitioned the FCC on April 17, asserting that it appeared that action on its funding request had been delayed because of an ongoing investigation of its service provider, Education Networks of America.
The Wireline Competition Bureau is soliciting comments on whether there are unique circumstances that warrant the approval of a so-called "Operational SPIN change" before a funding commitment is issued, and whether permitting such a change would be consistent with the public interest. It also is soliciting input on whether and how program procedures should be modified to address Tennessee's request.
In its petition, Tennessee contended that its statewide Internet services would be jeopardized if its funding request was not approved by the end of the current funding year on June 30, 2003.
Comments are due by April 30, 2003 and reply comments by May 5, 2003.
