June Appeal Decisions Released by FCC

On June 30, 2023, the FCC issued its monthly Public Notice deciding requests for review, requests for waiver, and petitions for reconsideration related to actions taken by USAC.

The FCC resolves requests that are consistent with its precedent by issuing a “streamlined” list of decisions and classifying the matters based on the issue involved and the FCC rule in question.

E-rate Program

  • Appeals involving the following issues were granted:
  • Granting Applicant Additional Time to Respond
  • Granting on Reconsideration – Late-Filed FCC Form 471
  • Incorrect Service Start Date on FCC Form 486
  • Late-Filed FCC Form 471 Applications – Filed Within 14 Days of the Close of the Window
  • Ministerial and/or Clerical Errors – FRN Omitted from FCC Form 471 Application
  • Ministerial and/or Clerical Errors – Invoicing
  • Signed Contract Requirement
  • Waiver of Appeal Filing Deadline
  • Waiver of Special Construction Service Delivery Deadline

Appeals involving the following issues were denied:

  • Late-Filed FCC Form 471 Applications
  • Late-Filed Invoice or Invoice Deadline Extension
  • Untimely Filed Appeals or Waiver Requests

Three E-rate appeals were dismissed on reconsideration.

Emergency Connectivity Fund Program

ECF appeals granted for the following issues:

  • Early Delivery
  • Granting Additional Time to Respond to USAC’s Request for Information
  • Late-Filed FCC Form 471 Applications – Circumstances Beyond Applicant’s Control
  • Ministerial and/or Clerical Errors
  • Payment Verification
  • Waiver of Appeal Filing Deadline
  • Waiver of Appeal Filing Deadline – USAC Error Resulted in Late-Filed Appeal
  • Waiver of Service Delivery Date
  • Waiver of Special Construction Service Delivery Date

Two ECF appeals were denied for being filed untimely.
