The FCC recently waived their rules for two applicants who failed to file the Forms 471 by the filing window deadline. This decision is consistent with the Commission’s Academy of Math and Science Order.
In 2010, the FCC found in Academy of Math and Science Order that even though 97 applicants did not file within the allotted time outlined in the filing window, “the petitioners either timely filed their FCC Forms 471 or…demonstrated that special circumstances exist to justify a waiver”.
The FCC continued this precedent and granted the waivers Al-Noor School of Brooklyn, NY and Maimonides School of Brookline, MA. In both cases, the petitioners demonstrated special circumstances to justify the waiver, and the FCC “[found] no evidence of evidence of waste, fraud or abuse”. In both cases, the applicants had filed their Form 471 within 14 days of the application window closing.
Nine applicants were not granted waiver through this order, as they were not able to present special circumstances to justify a waiver of the Commission’s rules.
