Key Changes to the Proposed Funding Year 2025 ESL: What You Need to Know

Every year, the FCC releases a draft Eligible Services List (ESL) for public comment, and this year is no different. On July 31, 2024, the FCC posted the draft ESL for the E-rate Program. Understanding these updates is crucial for making the most of your funding opportunities.

The most notable change in the draft ESL is the inclusion of Wi-Fi hotspots and mobile services for use with these hotspots. This update aligns with the Wi-Fi Hotspot Report and Order recently adopted by the Commission. The draft also clarifies that Wi-Fi hotspots and mobile wireless Internet service are now eligible under Category One.

Other important changes in the draft ESL include:

  • An updated definition of “wireless” service under Category One to encompass fixed wireless, microwave, and mobile services for school buses and Wi-Fi hotspots, reflecting new eligibility for off-premises use.
  • Clarifications on the eligibility of off-campus Wi-Fi hotspots and mobile Internet services based on recent rulings.
  • Modifications to the explanation of off-campus wireless services on school buses and a requirement for cost-allocation of E-Rate-funded services.
  • A specification that the cost-effectiveness test for data plans and air cards applies only to on-campus use, ensuring that requests for mobile connectivity are not duplicative where existing broadband is available.

The FCC invites interested parties to file comments on the proposed ESL by August 30, 2024, with reply comments due by September 16, 2024. However, you can start planning now using the draft ESL.

Funding Year 2025 will be the final year of the current Category Two budget cycle. If you have remaining funds, this is an ideal time to evaluate whether your institution needs any equipment upgrades.
